Gift Voucher Rules & Regulations

1. Gift Vouchers and unused portions of Gift Vouchers expire two years from the date of issuance.
2. Gift Vouchers must be redeemed through the WHSmith eBookShop web site, http://ebooks.whsmith.co.uk toward the purchase of products listed in the WHSmith eBookShop's online catalog.
3. Gift Vouchers may only be redeemed for the purchase of digital products available through the WHSmith eBookShop web site. They cannot be redeemed for purchase of physical products such as books, CDs, DVDs, videos, etc., through WHSmith.com or for any products available through any third-party seller associated with WHSmith.com.
4. You must have a valid email address to purchase and redeem a Gift Voucher.
5. Gift Vouchers cannot be used to purchase other Gift Vouchers.
6. Promotional offers, coupons and discounts may not be applied toward the purchase of an WHSmith eBookShop Gift Voucher.
7. The total value of the Gift Voucher will be applied against the total order amount including sales tax.
8. If your order exceeds the amount of your Gift Voucher, you must pay for the balance with a credit card.
9. The original expiration date will apply to any unused balance.
10. Gift Vouchers are non-refundable and are not redeemable for cash.
11. No VAT (sales tax) is charged when buying a Gift Voucher; however, purchases paid for with a Gift Voucher will be charged applicable VAT.
12. Gift Vouchers and their use on the WHSmith eBookShop web site are subject to WHSmith's general Terms and Conditions, and Privacy Notice.
13. The WHSmith eBookShop is not responsible for lost or stolen Gift Vouchers.
14. WHSmith will have the right to close customer accounts and request alternative forms of payment if a fraudulently obtained Gift Voucher is either redeemed through the WHSmith eBookShop web site or is redeemed and used to make purchases on the WHSmith eBookShop web site.
15. OVERDRIVE, INC. TOGETHER WITH ITS SUBSIDIARIES, AND ITS SUPPLIERS AND AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT VOUCHERS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT VOUCHER CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT VOUCHER. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
16. WHSmith reserves the right to change these rules and regulations from time to time at its discretion and without notification.

WHSmith eBookShop Gift Vouchers are issued and sold by OverDrive, Inc. a Delaware corporation, and its subsidiaries. The risk of loss and title for Gift Vouchers pass to the purchaser upon our electronic transmission to the recipient or delivery to the carrier, whichever is applicable.
